This website and online store are operated by Gordon Bruce Fine Art. Throughout these Terms, “we,” “us” and “our” refer to Gordon Bruce Fine Art.

Our store is hosted by Shopify, which provides the ecommerce platform that enables us to sell our products and services.

These Terms apply when you browse our website, contact us through it or purchase products or services from us. By using the website, you agree to these Terms, together with our Privacy Policy, Return and Refund Policy and Shipping Policy.

Nothing in these Terms limits any consumer rights that cannot legally be excluded under the laws applicable to you.

2. Eligibility and Customer Information

You must be legally capable of entering into a contract to place an order. If you are under the age of majority where you live, you may use this website only with the involvement of a parent or legal guardian.

You agree to provide accurate, current and complete information when placing an order and to update that information when necessary.

You are responsible for protecting any account credentials associated with the store and for activity conducted through your account.

3. Products and Artwork

We make reasonable efforts to describe and photograph products accurately. Colours, contrast, scale and appearance may vary slightly depending on lighting, photography and the settings of your screen.

Original paintings are individually created works and may contain natural variations in texture, brushwork and surface appearance. Product measurements are approximate unless expressly stated otherwise.

Frames, mounts, display accessories or other items shown in photographs are included only where the product description expressly says so.

We may update descriptions, withdraw products or limit availability at any time. Because original paintings are unique and may also be offered through other sales channels, an item may occasionally become unavailable before our website inventory is updated. If this happens after you order, we will contact you and issue a full refund.

4. Orders and Contract Formation

Submitting an order is an offer to purchase. An automated order acknowledgement confirms that we have received your order but does not necessarily mean that it has been accepted.

A contract is formed when we confirm acceptance of the order or dispatch the product, whichever occurs first.

We may decline or cancel an order where, for example:

  • The item is unavailable;

  • Payment cannot be authorised;

  • Pricing or product information contains a material error;

  • We cannot deliver to the supplied address;

  • We reasonably suspect fraud or unlawful activity; or

  • The order breaches these Terms.

If we cancel an order after payment has been taken, we will refund the amount paid.

Please review your order and delivery details carefully before submitting it. Contact us promptly if you notice an error.

5. Prices, Payment and Import Charges

Prices are displayed in the currency shown on the website. The final price, delivery charge and any applicable taxes collected by us will be shown during checkout before you place the order.

Customers ordering from outside the United Kingdom may have to pay customs duties, import taxes, brokerage charges or other fees imposed by the destination country. Unless checkout expressly states otherwise, these charges are not included in the purchase price and are the customer’s responsibility.

Currency-conversion charges may be applied separately by your bank or payment provider.

We may correct genuine pricing errors. If an obvious error affects an order already placed, we will contact you and allow you to proceed at the correct price or cancel for a full refund.

6. Commissions and Personalised Artwork

A commission is artwork created or altered according to a customer’s specifications. The agreed subject, size, price, payment schedule and other important details should be confirmed in writing before work begins.

Any deposit terms and approval stages specifically agreed for a commission form part of the contract for that commission.

Once work on a commission has begun, changes outside the agreed brief may incur an additional charge or require a revised completion date. We will discuss and agree any material additional charge before carrying out the extra work.

Commissioned, custom-made and personalised products cannot normally be cancelled or returned merely because the customer has changed their mind. This does not affect the customer’s rights where an item is faulty, damaged, misdescribed or does not conform to the agreed specification.

Unless expressly agreed otherwise in writing, purchasing a commissioned or original artwork does not transfer copyright or reproduction rights in the artwork.

7. Shipping and Delivery

Shipping methods, estimated processing times, estimated delivery times and relevant charges are described in our Shipping Policy or shown at checkout.

Delivery dates are estimates unless we have expressly agreed a guaranteed date. Delays may occur because of customs processing, severe weather, carrier disruption or other circumstances beyond our reasonable control.

Where UK consumer law applies and we arrange delivery, the goods remain at our risk until they come into the physical possession of the customer or another person identified by the customer to receive them, except where the customer independently appoints a carrier not offered by us.

Please contact us promptly if a parcel is delayed, lost or arrives damaged. Keep the item, packaging and delivery label and provide photographs when requested so that we can investigate with the carrier.

8. Cancellations, Returns and Refunds

Cancellations, returns, damaged items and refunds are governed by our Return and Refund Policy, available through the website footer.

Nothing in these Terms or our Return and Refund Policy excludes statutory rights relating to faulty, damaged or misdescribed goods.

9. Intellectual Property

Unless otherwise stated, the artwork, images, photographs, text, videos, graphics, branding and other original content displayed on this website are owned by or licensed to Gordon Bruce Fine Art and are protected by applicable intellectual-property laws.

The purchase of an original painting, print or commissioned artwork transfers ownership of the physical item only. It does not transfer copyright, commercial reproduction rights or the right to create derivative products.

You may not reproduce, modify, distribute, sell, license, publish, commercially exploit or use our artwork or website content to train an artificial-intelligence system without prior written permission.

You may share links to public pages on the website and may share unmodified website images for genuine personal, non-commercial purposes provided that Gordon Bruce Fine Art is clearly credited and the image is linked back to our website.

10. Acceptable Use

You must not use the website:

  • For an unlawful or fraudulent purpose;

  • To infringe our rights or another person’s rights;

  • To introduce viruses, malicious code or harmful technology;

  • To interfere with the security or operation of the website;

  • To collect personal information about other users without authority;

  • To send spam or misleading communications; or

  • To scrape, copy or systematically extract website content without permission.

We may restrict or terminate access where we reasonably believe these Terms have been breached.

11. Third-Party Services and Links

The website may contain links to or integrations with services operated by third parties, including payment providers, delivery companies and social-media platforms.

Those services are governed by their own terms and privacy policies. We are not responsible for third-party websites or services that we do not control, although this does not affect any responsibility we have for providers acting on our behalf in fulfilling your order.

12. Shopify

Our store is hosted by Shopify. Purchases made through the store are made directly from Gordon Bruce Fine Art, not Shopify. Shopify provides the ecommerce technology used to operate the store and processes certain information as described in our Privacy Policy and Shopify’s own privacy notices.

13. Reviews and Submitted Content

If you submit a review, photograph, comment or other content for publication, you confirm that you have the right to provide it and that it is accurate, lawful and does not infringe another person’s rights.

You grant us a non-exclusive, worldwide, royalty-free licence to display, reproduce and use that submitted content for operating and promoting Gordon Bruce Fine Art. You retain ownership of your original content.

We may decline, edit or remove submitted content where reasonably necessary, including content that is unlawful, abusive, misleading, irrelevant or infringing.

14. Website Availability and Information

We try to keep the website available, secure and accurate, but cannot guarantee uninterrupted or error-free access.

We may correct errors, update information, carry out maintenance or change the website where reasonably necessary. This does not affect contracts already formed or rights that customers have under applicable law.

15. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

Nothing in these Terms excludes or restricts statutory consumer rights.

Subject to those protections, we are not responsible for losses that were not reasonably foreseeable when the contract was formed, or for business losses suffered by someone purchasing wholly or mainly for business purposes.

Our collection and use of personal information are described in our Privacy Policy, available through the website footer.

17. Changes to These Terms

We may update these Terms to reflect changes to our services, business practices or legal obligations. The revised Terms will be posted on this page with an updated date.

Changes will not retrospectively alter a contract already formed unless required by law or agreed with the customer.

18. Severability

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be treated as modified or removed only to the extent necessary. The remaining provisions will continue in effect.

19. Governing Law

These Terms and any dispute or claim arising from them are governed by the laws of Scotland.

The Scottish courts will have jurisdiction, except that a consumer living elsewhere may also have the right to bring proceedings in the courts of the country or region where they live and may benefit from mandatory protections under their local law.
